Please read these Terms of Service carefully before using any services provided by Lesix Companies LLC. By accessing our websites, purchasing a service, enrolling in a program, or using any platform operated by Lesix Companies LLC, you agree to be bound by these Terms. If you do not agree, do not use our services. Certain services are governed by supplemental terms, which are incorporated by reference and noted where applicable.

1. About Lesix Companies

These Terms of Service ("Terms") govern your use of the websites, platforms, products, and services provided by Lesix Companies LLC ("Lesix," "we," "us," or "our"), a Georgia limited liability company located at 80 Seven Hills Blvd, Suite 101 #103, Dallas, GA 30132.

Lesix Companies LLC operates the following brands and platforms, all of which are governed by these Terms:

The Lesix Agency — done-for-you marketing consultancy serving real estate professionals and brokerages

Lesix Media — public affairs and communications brand

90MM / 90-Minute Marketing Department — AI-powered marketing systems framework and educational program (also subject to the 90MM Supplemental Terms at lesix.com/90mm-terms-and-conditions)

Lesix Games — gaming and interactive entertainment brand

Any additional brands, sub-brands, or platforms operated by Lesix Companies LLC now or in the future

References to "our Websites" include all domains and subdomains operated by Lesix Companies LLC, including but not limited to lesix.com, lesix.agency, lesixmedia.com, lesixdirect.com, lesix.pro, and any associated subdomains. These Terms incorporate our Privacy Policy at lesix.com/privacy-policy by reference.

We reserve the right to modify these Terms at any time. Material changes will be communicated via a notice on our Website or by email. Your continued use of our services following any such changes constitutes your acceptance of the updated Terms. It is your responsibility to review these Terms periodically.

2. Eligibility and Account Registration

2.1 Eligibility

Our services are intended for adults and businesses only. By using our services, you represent and warrant that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and are not prohibited from using our services under applicable law. If you are using our services on behalf of a business or other legal entity, you further represent that you have the authority to bind that entity to these Terms.

2.2 Account Registration

Certain services require you to create an account. When registering, you agree to provide accurate, current, and complete information and to keep that information updated. You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Our employees will never ask you for your password. If you become aware of any unauthorized use of your account, you must notify us immediately at [email protected].

2.3 Non-Transferability

Accounts are non-transferable. You may not assign, share, or transfer your account or any rights under these Terms to any third party without our prior written consent. Lesix may, at its sole discretion, assign these Terms or any of its rights hereunder to any third party or successor entity.

3. Services

3.1 Scope of Services

Lesix provides a range of services across its brands. The specific scope of services applicable to your engagement will be described in your order, enrollment confirmation, service agreement, or applicable supplemental terms. The following general categories of services are offered:

Done-for-You Marketing and Consulting (The Lesix Agency): Strategic marketing consulting, campaign development, and communications services delivered to real estate professionals and organizations. Specific deliverables, timelines, and engagement terms will be set forth in a separate service agreement or statement of work.

AI Employee Systems and Marketing Frameworks (90MM): Development, delivery, and licensing of AI-assisted marketing systems, documented business processes, and the 90-Minute Marketing Department framework. These services are also subject to the 90MM Supplemental Terms at lesix.com/90mm-terms-and-conditions, which govern licensing, permitted uses, and restrictions specific to that program.

Courses and Educational Programs: Online and in-person courses, workshops, masterclasses, and training programs offered through Lesix brands and partner institutions. Enrollment constitutes acceptance of these Terms and any program-specific policies communicated at time of enrollment.

SaaS Platform Access: Subscription-based access to software platforms operated by or through Lesix Companies LLC, including LesixPro and any associated tools. Platform-specific terms may apply and will be provided at the time of subscription.

3.2 No Guarantee of Results

You understand and acknowledge that Lesix cannot guarantee specific outcomes, results, revenue, or performance from use of any of our services, frameworks, or platforms. Marketing results depend on many factors outside our control, including your implementation, market conditions, and the performance of third-party tools and platforms. Any case studies, testimonials, or examples referenced in our marketing materials represent past results and are not a guarantee of future performance.

3.3 AI-Generated Content

Certain services involve the use of artificial intelligence tools to generate content, automate workflows, or produce marketing materials. You acknowledge and agree that AI-generated content may contain errors, inaccuracies, or outputs that require review and modification. You are solely responsible for reviewing, verifying, editing, and approving any AI-generated content before using it in any professional, legal, or public-facing context. Lesix makes no warranty regarding the accuracy, completeness, or fitness for purpose of AI-generated outputs. For additional terms governing AI systems and the 90MM framework specifically, please refer to the 90MM Supplemental Terms at lesix.com/90mm-terms-and-conditions.

3.4 Third-Party Platforms and Integrations

Some of our services are delivered through or integrate with third-party platforms, including HighLevel (GoHighLevel). Your use of such platforms is also subject to the terms and conditions of those third parties. We are not responsible for the availability, performance, or terms of third-party platforms. Changes to third-party platforms may affect the delivery or functionality of certain Lesix services, and we are not liable for any such impact.

3.5 Service Modifications

We reserve the right to modify, suspend, or discontinue any service or feature at any time, with or without notice. We will make reasonable efforts to notify you of material changes that affect active subscriptions or ongoing engagements. We are not liable to you or any third party for any modification, suspension, or discontinuation of services.

3.6 Temporary Interruptions

You understand that temporary interruptions to our services may occur due to maintenance, technical issues, or factors outside our reasonable control. Services are provided on an "as is" and "as available" basis, and we assume no responsibility for any interruption, delay, or failure to store user data or settings.

4. Payment and Billing

4.1 Fees

You agree to pay all fees associated with the services you purchase. Fees vary by service type and are disclosed at the time of purchase or enrollment. We reserve the right to modify our pricing at any time. For subscription-based services, pricing changes will be communicated in advance and will take effect at your next billing cycle unless you cancel prior to that date.

4.2 Billing and Authorized Charges

By providing payment information, you authorize Lesix to charge the payment method on file for all applicable fees. Subscription fees are billed in advance of the service period. You agree to maintain accurate and current billing information, including a valid payment method, and to update that information within ten (10) days of any change.

4.3 Overdue Amounts and Collections

If your payment method is declined or fails for any reason, we reserve the right to suspend or terminate your access to services until all overdue amounts are resolved. You agree to reimburse Lesix for any third-party chargeback fees, penalties, or collection costs incurred as a result of non-payment. In the event legal action is required to collect overdue balances, you agree to reimburse us for all associated costs including reasonable attorney fees.

4.4 Refund Policy

All fees paid for Lesix services are generally non-refundable. No prorated refunds or credits will be issued for partially used subscription periods. Exceptions may be made at our sole discretion in the following circumstances:

Where we materially modify these Terms or our Privacy Policy during a billing period in a manner that adversely affects you, we may issue a prorated refund for the unused portion of your subscription term.

Where a service modification or interruption adversely affects you and no suitable alternative remedy is available, we may issue a partial refund as we determine appropriate or as required by applicable law.

Course and educational program refund eligibility, if any, will be communicated at the time of enrollment and may vary by program.

To request a refund under an eligible circumstance, you must submit written notice to [email protected] identifying your account and the specific service for which a refund is requested. The issuance of a refund in one instance does not obligate Lesix to issue refunds in future instances.

4.5 Cancellation

To cancel a subscription or ongoing service, you must provide written notice to Lesix at least thirty (30) days before your next billing date.

Cancellation notices may be submitted to [email protected]. Cancellation will be effective upon our confirmation of receipt and verification of your authorization. You will retain access to the service through the end of the current paid billing period. If your access was provided by a third party rather than purchased directly from Lesix, you must contact that party to manage your cancellation.

5. Intellectual Property

5.1 Lesix Intellectual Property

All content, materials, frameworks, systems, software, graphics, logos, trademarks, and intellectual property available on or through our Websites and services — including but not limited to the 90-Minute Marketing Department framework, AI employee systems, training materials, templates, and course content — are owned by or licensed to Lesix Companies LLC and are protected by applicable United States intellectual property laws.

Nothing in these Terms grants you any ownership right, title, or interest in any Lesix intellectual property. You may not copy, reproduce, modify, distribute, republish, reverse engineer, or create derivative works from any Lesix content or materials without our prior written permission.

5.2 Your Content and Data

You retain all ownership rights to data, content, and materials you submit to Lesix in connection with your use of our services ("Your Content"). By submitting Your Content, you grant Lesix a limited, non-exclusive license to use, process, and store Your Content solely as necessary to deliver the services you have engaged us to provide, consistent with our Privacy Policy at lesix.com/privacy-policy.

You represent and warrant that you own or have all necessary rights to Your Content, that Your Content does not infringe any third-party intellectual property rights, and that you have the legal authority to grant the license described above.

5.3 AI Output Ownership

Content or materials generated by Lesix's AI systems using Your Content as input and delivered to you as part of a paid engagement become your property upon delivery, subject to any restrictions set forth in the applicable service agreement or supplemental terms. Lesix retains no ownership interest in such delivered outputs. However, Lesix retains the right to use anonymized, aggregated learnings from AI interactions to improve its systems and frameworks, provided that no personally identifiable or client-identifiable data is retained or used for this purpose without your consent.

5.4 Feedback and Suggestions

If you provide Lesix with feedback, suggestions, or ideas regarding our services, you grant us a perpetual, irrevocable, royalty-free license to use and incorporate such feedback into our products and services without any obligation of compensation or attribution to you.

5.5 DMCA Copyright Policy

We respect intellectual property rights and expect our users to do the same. If you believe content on our Websites infringes your copyright, please submit a notice to [email protected] including: a description of the copyrighted work; the URL or location of the allegedly infringing content; your contact information; a statement of good faith belief that the use is unauthorized; and a statement under penalty of perjury that the information provided is accurate and that you are authorized to act on behalf of the copyright owner.

6. User Conduct

Your use of our Websites and services is subject to all applicable laws and regulations. You agree that you will not use our services to:

- Post, transmit, or distribute content that is unlawful, defamatory, fraudulent, harassing, abusive, obscene, or that violates any third party's rights

- Discriminate against or harass any individual or group on the basis of religion, gender, sexual orientation, race, ethnicity, age, disability, or any other protected characteristic

- Infringe any patent, trademark, trade secret, copyright, or other intellectual property right

- Transmit unsolicited bulk communications, spam, or any unauthorized advertising

- Upload or introduce malicious code, malware, or any software designed to damage, disrupt, or gain unauthorized access to any system

- Impersonate any person or entity, including Lesix employees or representatives

- Attempt to gain unauthorized access to any Lesix system, account, or network

- Use our platforms or AI systems to generate content that is deceptive, fraudulent, or intended to mislead consumers

- Violate any applicable local, state, federal, or international law or regulation

We reserve the right to remove any content that violates these standards and to suspend or terminate accounts associated with prohibited conduct, without prior notice and without liability.

7. Client Responsibilities

7.1 Accuracy of Information

You are responsible for the accuracy, completeness, and legality of all information, data, and materials you provide to Lesix in connection with our services. We rely on the information you provide to deliver our services, and we are not responsible for outcomes resulting from inaccurate or incomplete information supplied by you.

7.2 Use of Deliverables

You are solely responsible for how you use, deploy, or distribute any deliverables, content, frameworks, or AI-generated outputs provided by Lesix. This includes compliance with applicable laws governing advertising, marketing, data privacy, real estate licensing, and professional conduct in your jurisdiction.

7.3 Pass-Through Obligations

If you use Lesix services on behalf of your own clients or provide your clients with access to any Lesix platform or deliverable, you must: implement and enforce your own privacy policy providing at least the level of protection described in our Privacy Policy; obtain all necessary consents from your clients; and ensure your clients are bound by terms consistent with these Terms of Service. You assume full responsibility for your clients' use of any Lesix services, outputs, or platforms you share with them.

8. Stored Data and Platform Access

Subject to our Privacy Policy, Lesix assumes no responsibility or liability for the deletion or failure to store any content maintained or transmitted through our platforms. We reserve the right to remove or terminate accounts that have not paid applicable subscription fees, that have remained inactive for more than one (1) year, or that have violated these Terms. You are responsible for maintaining independent backups of any data or content you consider important.

9. Disclaimer of Warranties

ALL SERVICES, CONTENT, AND PLATFORMS PROVIDED BY LESIX ARE OFFERED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

LESIX DOES NOT WARRANT THAT: (A) OUR SERVICES WILL MEET YOUR SPECIFIC REQUIREMENTS OR EXPECTATIONS; (B) OUR PLATFORMS WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) ANY RESULTS OBTAINED THROUGH USE OF OUR SERVICES WILL BE ACCURATE, RELIABLE, OR EFFECTIVE; OR (D) ANY AI-GENERATED CONTENT OR OUTPUT WILL BE FREE FROM ERRORS, INACCURACIES, OR DEFECTS.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES. IF APPLICABLE LAW IN YOUR JURISDICTION PROHIBITS SUCH EXCLUSIONS, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

10. Limitation of Liability and Indemnification

10.1 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LESIX'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF OUR SERVICES SHALL BE LIMITED TO THE TOTAL AMOUNT YOU PAID TO LESIX IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

IN NO EVENT SHALL LESIX OR ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITY, OR GOODWILL, EVEN IF LESIX HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10.2 Indemnification

You agree to defend, indemnify, and hold harmless Lesix Companies LLC and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorney fees) arising out of or related to: (1) your use of our services or platforms; (2) Your Content or any data you submit through our services; (3) your breach of these Terms; (4) your violation of any applicable law or third-party right; (5) any dispute between you and your own clients arising from services, deliverables, or platforms you shared with them; or (6) any negligent or willful misconduct by you or your employees or agents.

11. Terms and Termination

11.1 Term

These Terms are effective upon your first use of any Lesix service and remain in effect until terminated by either party in accordance with this Section.

11.2 Termination by Lesix

We may suspend or terminate your access to all or any part of our services at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to, breach of these Terms, non-payment, suspected fraudulent or abusive activity, or conduct that may expose Lesix or its users to legal liability.

11.3 Effect of Termination

Upon termination, your right to access and use our services ceases immediately. Lesix is not liable to you or any third party for any claims arising from suspension or termination. The following sections survive termination: Section 5 (Intellectual Property), Section 7 (Client Responsibilities), Section 9 (Disclaimer of Warranties), Section 10 (Limitation of Liability and Indemnification), Section 12 (Governing Law and Disputes), and any obligation to pay fees incurred prior to termination.

12. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law principles. You agree to submit to the exclusive personal jurisdiction and venue of the state and federal courts located in Paulding County, Georgia for resolution of any dispute arising out of or related to these Terms or your use of our services.

Before initiating any formal legal proceeding, you agree to contact Lesix at [email protected] and provide a written description of the dispute, your proposed resolution, and your contact information. Both parties agree to make a good faith effort to resolve the dispute informally for a period of thirty (30) days before pursuing formal legal action.

13. Miscellaneous

13.1 Entire Agreement

These Terms, together with our Privacy Policy and any applicable supplemental terms (including the 90MM Supplemental Terms), constitute the entire agreement between you and Lesix Companies LLC with respect to your use of our services, and supersede all prior agreements and understandings. In the event of a conflict between these Terms and any supplemental terms, the supplemental terms will govern with respect to the specific service they address.

13.2 Severability

If any provision of these Terms is found to be invalid or unenforceable under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

13.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be made in writing and signed by an authorized representative of Lesix to be effective.

13.4 Force Majeure

Lesix shall not be liable for any delay or failure to perform its obligations under these Terms due to causes beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, governmental actions, internet or infrastructure outages, or failures of third-party platforms and service providers.

13.5 Notices

Notices to Lesix must be submitted in writing to [email protected]. We may provide notices to you via email to the address on file with your account or via a prominent notice posted on our Website. Notices are deemed delivered on the date of confirmed transmission by email, or two (2) business days after mailing if sent by postal mail.

13.6 Electronic Communications

By creating an account or using our services, you consent to receive electronic communications from Lesix, including service notices, billing communications, and marketing messages (subject to your opt-out rights). Lesix will never send communications requesting your password or sensitive account credentials. If you receive such a request purportedly from Lesix, do not respond and report it immediately to [email protected].

13.7 International Use

Our services are operated from the United States. We make no representation that our services are appropriate or available for use in locations outside the United States. If you access our services from outside the United States, you do so at your own risk and are responsible for compliance with all applicable local laws.
